ACCEPTANCE OF TERMS: the giving or sending of an order constitutes an acceptance of these terms by the buyer who, if he does not accept these terms must notify the seller immediately.

PACKAGING: packaging will be charged at cost price to the buyer. We cannot accept this back.

DELIVERIES: without any instructions the seller will choose the best way for the cheapest and more efficient type of transport, no claim will be accepted, it will be ever at risk of the customer. ORDER: are registered as priority in chronological scale, in case of poor harvest due to climate issues and or other adverse season’s elements, we will be obliged to pro-rate ordered quantities.

WARRANTIES: Seeds supplied comply with legal minimum standard of germination and purity. In case of claims, liability of De Corato Sementi SRL is limited to the value of the disputed goods. The goods alwais travel at the buyer risk, even if delivered with Free port or Carriage paid. The seller is not liable for failure to fullfit its obligations under these terms and conditions if such failure is due to causes beyond its reasonable control including but not limited to natural disasters, fire, floods, war, strike, labor disputes or shipping delays. CLAIMS: I.F.S. rules will be applied for all sales. Claims regarding quantity must be received within 3 days after receiving of the goods. Claims regarding purity and aspect of goods within 8 days of receiving the goods. Concerning germination, claims must be received within 45 days after receiving of goods, proven by official certificate of germination. Regarding varietal purity, claims and be accepted within the regular sowing cycle and not later than the end of the agriculture year. For any dispute the competent court is that of the selling company.

PAYMENT the payment will be valid from the moment it is received in the seller’s bank account. For payments received after the due date, legal interest will be applied. No discounts or roundings on the invoice amount are allowed.
